Berehayes Holiday Cottages – Booking Conditions (effective 31/03/2023)

  

Our Agreement with You

When you submit a rental booking via our online reservation system you, as the ‘ lead booker’, will receive an automatically generated booking summary by email and our rental contract will be with you. This does not form a contract between us.  A rental contract, which incorporates these booking conditions, is formed between us once your booking has been confirmed and a payment (deposit or full payment, including booking fee) has been received.

The rental property

Is only to be used for the purposes of holiday during the period booked and not for any other purpose or period of time. There is no relationship created of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the rental Period.

Payments

​If your arrival date is less than 6 weeks full payment is required.

If your arrival date is more than 6 weeks (42 days) away, only a deposit of 25% of the booking total is required. The deposit will only be refunded according to the cancellation conditions.

Full booking balance must be paid 42 days before arrival. If it is not paid 10 days after our reminder email is sent the booking will be cancelled with no refunds.

Cancellation Conditions

If you do not have insurance at the time of booking with us we do recommend that you take out a policy. Your Holiday Cottage rental should be covered by any holiday insurance policy you may have and it should be your first ‘port of call’ including for covid. If there is a Government lockdown that effects your stay, full refunds will be given. For other cancellation reasons, insurance is recommended. Refund protection is available with X Cover.com . Cost shown during booking process.

If you do not have insurance the following can be applied:-

  • If the booking is cancelled 42 days or more before arrival, the 25% deposit will be retained. Alternatively a new booking can be made using this deposit less a £75 booking fee.
  • If the booking is cancelled less than 42 days before arrival then a charge equal to the full booking amount will be made. However, you can request for us to re-market the cottage and a voucher can be issued for 75% of the amount we resell the booking for less a £75 admin fee. 
  • In the event of a ‘no show’ or you leave before your departure date the full cost of the booking is charged.

We do offer refund protection with “X cover”, this is a separate contract between yourselves and this company.

Other conditions

Bed linen & towels are provided. No loud music is to be played inside or outside your accommodation, other noise should be limited after midnight. Anti-social behaviour will not be tolerated.

Cottages have an electricity meter, charges can be made for excessive use.

Non-availability of accommodation as booked

We would only cancel your rental if the accommodation was unavailable for reasons beyond our reasonable control (e.g. fire, flood, exceptional weather conditions, and damage/destruction). We would attempt to offer you alternative accommodation, however if this was either not possible or not acceptable to you then we would refund to you all monies paid for the rental.  Alternatively you can take a voucher for 110% of the value to allow you to rebook, at your convenience, for a stay to commence within 1 year. Our liability to you would not extend beyond this refund. No additional compensation, expenses or costs will be payable.

 Damage and Breakages

The hirer is responsible for the accommodation and is expected to take all reasonable care of it. You are responsible for any breakages or damage you cause to the accommodation and its contents. Please report these before you leave, otherwise we will send you an invoice which will also include an administration charge of £25.00. Note that we do not normally charge for minor breakages (e.g. glassware, crockery) provided that these have been reported.

 Party size

Under no circumstances may more than the maximum number of persons (excluding infants), as stated on our website, occupy a property except by prior agreement. The hirer agrees not to cause nuisance or annoyance to occupants of nearby properties. 

Web Site

We make every effort to ensure that the information and accommodation descriptions contained on our own and other web sites are accurate. We do however reserve the right to make small changes and we accept no liability for  inaccuracies.

Smoking

All accommodation is strictly non-smoking inside.  A charge of £200 will be made for extensive cleaning if the accommodation has been smoked in. We do however provide ‘smokers outpost’ disposal points for anyone wishing to smoke outside.

Pets

Well behaved pets up to 30 kgs (maximum 2), over 12 months old are allowed in some of the cottages (Smugglers, Barley, Hayloft, Honeypot and Dairy) and must be declared at the time of booking. Owners must bring their own pet bed. To pay for an extensive clean there is a £15 per night charge. The owner will be responsible for the costs of any excessive cleaning requirements or damage. Dogs need to be kept away from bedding, furniture and carpeted areas.  There are simple stairgates which can be used for dogs in the old coal bunker in the courtyard. Do not leave dogs in the cottages alone, there is a dog cage available on request. Outside of the cottage dogs must be accompanied and be kept on a lead at all times. If you arrive with a dog for a non-dog permitted cottage you will need to use the dog cage overnight, for ONE night which should be kept on view close to your door. Arrangement should be made with kennels etc for the rest of your stay.

Arrival

To ensure that there is sufficient time to clean and prepare your accommodation, we ask that you should arrive after 4 pm. 

Departure

To enable us to prepare for our next guests please vacate your accommodation by 10 am on the morning of your departure. To assist our cleaners, we ask that you leave the property in a clean and tidy condition. Please sign out of TV accounts like Netflix and Prime as we will not be liable for any unauthorised future costs. You can sign out from home, go to ‘Sign out of all devices’.

 

Liability

We do not accept liability for damage, loss or injury unless caused by proven negligent act or omission of ourselves, our employees or contractors, or agents of the same, whilst acting in the course of their employment. This includes loss or damage to vehicles and their contents, and to the personal possessions you bring with you.

Berehayes will not liable for any accident or injury occurring at the premises save where the accident or injury is as a result of the negligence or willful misconduct of the owners.

The guest(s) should not engage any third party to provide any service at the property without the consent of the owner (and where relevant the owner’s insurers) and that in making a request for consent, the guest should provide written details of the service provider (and any information requested by the owner’s insurers) and the service to be provided and that consent will only be given where the third party supplier has provided proof of appropriate insurance.

Berehayes will not accept liability for the activities of third party suppliers, even if recommended.  This will be based on the genuine belief and experience of the owner / or feedback received by the owner from other guests / contacts, and the owner shall not be liable for the failure of a particular service provider to properly perform the relevant services, this being a matter between the guest and the relevant third party service provider.

House Rules

Berehayes is not a party venue and is best suited to families and couples wanting a quiet retreat who can adhere to some house rules to respect us and other guests:-

  • No loud music is to be played inside or outside, other noise should be limited after midnight
  • Anti-social behaviour will not be tolerated
  •  If  house rules are broken you will be asked to leave immediately and there will be no refunds given.
  •  

General

  • Groups tend to move crockery between cottages (when eating together!), please replace it how you found it (items are colour coded and there is an inventory list to help you). Also furniture should be replaced to how it was found. There is a £25/ hour charge for us to sort items.
  • We ask that you respect the accommodation, treat it as you would your own and leave it as you found it.
  • CCTV is in use in the courtyard, car park and pool area and is used for monitoring only and no recordings are being made.

 

Swimming Pool Complex

  • Only registered guests can use the pool complex
  • Lone swimming is not permitted
  • No running jumping or diving in the pool.
  • No food, drink or glasses in the pool complex.
  • Children under the age of 16 must be supervised by an adult who can swim.
  • Facilities such as our pool, jacuzzi and sauna are complimentary within cost of your accomodation and therefore no refund can be given if not available due to circumstances outside our control.

 

Complaints 

Please make any complaint known to the owners immediately, so they can be addressed straightaway. Please do not leave it until after your departure. Any unresolved disputes may be referred to arbitration.
